Steven Marsh undertakes a wide and varied range of criminal law work including motoring offences and is a member of the Duty Solicitor Scheme for Carlisle. He regularly represents clients in Carlisle Magistrates Court providing an expert local defence service.
Steven has over 30 years post qualification experience in criminal law and regularly completes in excess of 100 cases each year at the police station, Carlisle Magistrates or Crown Courts.
At the police station Steven can often provide advice and attendance at Carlisle police station free of charge through the Legal Aid Agency. For the Magistrates and Crown Courts, legal aid is offered by our firm subject to means. Not all cases qualify for legal aid representation and if so advice will be given to you as to the likely level of costs of your case proceeding through the Magistrates or Crown Courts. This will normally be based on an hourly rate which is £175 per hour plus VAT for matters where you decide to plead guilty at the outset or £201 per hour plus VAT where a not guilty plea is proposed. With the exception of certain motoring offences we are unable to provide a fixed fee service in criminal law because of the range, diversity and complexity of the work involved. In motoring cases, which can only be dealt with in the Magistrates Court, we are able to offer a fixed fee service for cases where you wish to plead guilty.
Our charges for motoring matters dealt with at the first attendance at the Magistrates Court are £500 inclusive of VAT and travel costs but excluding any other disbursements. This fee includes taking your instructions by telephone, considering the evidence and providing advice on the likely sentence and attendance and representation at a single hearing at Carlisle Magistrates Court. It does not include the instruction of any expert witnesses, taking statements from any witnesses, advice and assistance in relation to a special reasons hearing or advice and assistance in relation to any appeal. It does not include a personal attendance (other than via telephone) prior to meeting at Court. We will explain the Court procedure to you so you know what to expect on the day of your hearing and the sentencing options available to the Court. We will meet with you before going into the hearing and would anticipate normally being at Court for between two and three hours in connection with your case. We will discuss the outcome with you. If you require advice on appeal and decide to lodge an appeal, this will carry an additional cost.
If you choose to enter a not guilty plea to a motoring matter which can only be dealt with in the Magistrates Court, we are unable to provide a fixed fee. This again is due to the range and complexity of cases with which we deal. The hourly rate will be as above and we would normally expect our charges for a matter proceeding to trial to be between approximately £1,000 and £1,500 plus VAT and disbursements.
Disbursements will include Steven’s travel to Court, normally about £25, plus the cost of any expert evidence we obtain on your behalf. If your case involves a trial of more than half a day or obtaining expert evidence, it is likely to fall outside these figures and further guidance should be sought.
